But, when someone enters US with AP, then his H1B becomes void. In that case what is the point of going back to Toronto to get the passport with H1B visa stamp which will have no value? Am I right?
His visa application is pending name check verification and they handed him his passport back saying they will call him once they receive NC clearance from DOS. So he had his passport with him and his AP so was able to come back.

Action item
I suggest we mail them our 2008 W2s and show them the taxes that we have paid here .....and that they are and will loose that tax dollar if there is no reform.
Send a copy of the W2 along with a brief letter to Mr President at the White House as well
We have to to talk to them in the language that they understand.
It is a capitalist country ...... Show them the power of dollars that we pay to them in taxes and that they could very well loose that along with the hi tech edge that they claim to have .
Add to it , that Immigrants are investing money off shore in real estate and businesses due to the instability and volatility of the Immi system

Employer prefers H1B because once you are back on H1B it will be chain you metaphorically. EAD gives you freedom. Once you are on H1B you will have lot of limitations and headaches maintaining it. My opinion.

NIW vs Labor: one more advantage- NIW has much more portability being a self petition. You can file an EB1 and also file NIW using the same documentation- it will cost you filing fees and offer you a second chance- a backup.

5. While you are it, tell us about last night's dream, in Hindi. Translate it into Cantonese and P-Language (remember, that?)
6. Create 10 threads asking whether more rallies are good or bad, supporting your cause to ban disruptive users
7. Invite the intellectual insight of users debating that the First Amendment applies to anyone whose feet have touched US soil, whether H1B or not

9. Keep dreaming that professionally-run programs run by scumbags like Numbers USA will really have to worry about IV

Hi All,
I too got the CPO on Sep 7, 2010. But we did not get any email about dependent application. After seeing this post, I just called the customer service and spoke with level 2 officer. According to him my application is still pending even though the online status and email shows approved. I am really concerned that still there is no approval. Moreover, I can not even open a SR because my status shows CPO. please advise me what to do.

Labor filed: Oct 2007
6 years H1 End Date: Sep 15 2008.
I was falling short by 45 days to meet the 365 days limit. So, my attorney suggested me to stay out of the country for about 50 days (5 days more to be on safe side) to get the 7th year extension based on 365 days rule. So, for the 50 days I was working from our India office. (Its not mandatory for you to work. Just a vacation should be fine if it is less number of days).
So, I was out country in Feb 2008 and Mar 2008. After coming back, In April 2008, filed for a re-capture petition to recapture the days spent outside the country. It was approved in July 2008. Filed for 7th year extension in August 2008 based on Labor pending for 365 days rule and got the approval in Nov 2008. Currently working on 7th year extension.

My list is the following (e-filers are asked not to send any photo or identification document, unless requested by USCIS):

USCIS returning the visa back to DOS. What is that mean to us?
That means, the visas are still available for the month of July-2007. That means they have to accept our application.
They can make cut off during the middle of the month only if they reach the statuary limit of 140,000 per year. If they process 139999 application and even if one is pending to reach statuary limit. They still can accept the application.
Any comment?

What is the procedure to get a civil marriage done in US? I already have a marriage certificate from India and also have submitted a copy along with AOS for my wife. Can I get a marriage certificate from US via civil marriage for the same date as I was married in India? Please advise.
In my experience the DMV will go only with the name on the US Visa and I-94 so if you don't make an issue they will issue a DL in her maiden name. So take that one now.
Consult with an attorney for creating document for name change and use it to change the H4/H1. Keep the name change documentation as a back up

Given that you will be starting at almost the same point in the process whether or not you decide to switch, the GC issue is tangential to your decision. The question then becomes: will changing jobs advance your career? You will have to answer that yourself but from what you have described about the old/new jobs, I would have accepted the new offer.

Looks like USCIS is finding some lost applications... for example, see EB2-I Demand
Mar 2010 CY 2006 ---- 10150
Apr 2010 CY 2006 ---- 9900
May 2010 CY 2006 ---- 9975
So, the general increment is 75 or multiples thereof and as there is no drop in total demand for EB2-I over past month (9975 now vs 9900 last month CY 2006 and 37350 now vs 37250 last month in total), maybe there is no movement for EB2-I this month either...

My attorney said AC21 is not mandatory, If you wish to submit or not submit that is OK. I asked him what would you suggest, He will not go for AC21.

Those who have gotten FP notices, what does the LUD message say on the USCIS website. Is there a specific message such as "We sent you a fp notice" etc.?

The most important thing is by law you need to report change in Address within 10 days of move. Not doing that can get you in trouble. So there is no work around on that issues unless you want to keep the house and commute to your work place. The question I have is whether this changes of address is in same city or different city? In case it is in same city it does not matter I have changed 3 addresses since filing my 485 and no queries because of that. But in case you are moving cities (could be states too) then yes it can trigger a query but in case you are in consulting then it should be fine because your company can say that you still have the job and it is part of your job responsiblities to travel.
One thing that worries me is the there is a field for "Employer info" on AR-11. The fact that I switched employers and never filed an AC21 might raise questions since my current employer is different than the sponsoring one. I would assume you haven't gone through employer change yourself?

AabTuagaGc: Congratulations on your marriage. apb is right. Get your spouse here on H4 and then add her to your existing 485 application. Your attorney should guide you when you can technically add her to your application.
On a lighter note: It seems you didn't do this research beforehand, shows me that it must have been love at first sight ;-)
